As user of the Photocenter website, you acknowledge having the required skills and means to access and use said website. You acknowledge having verified that the configuration used by the Photocenter website is virus-free and in perfect working order. You acknowledge having been informed that the Photocenter website is available for access 24 hours per day, 7 days per week, with the exception of cases of force majeure, information technology problems, problems linked to the telecommunications network structure or other technical difficulties. The Photocenter may interrupt access to its website for maintenance reasons. It shall endeavor to advise users beforehand.

Although ENGIE takes every precaution to protect online information on the website or information transmitted by means of the website to ENGIE, it can neither ensure nor guarantee that such information is totally secure.

You acknowledge that your use of any information is entirely at your own risk. ENGIE endeavors to provide you with available and verified information and/or tools but cannot be held liable for errors, lack of availability of information and/or the presence of any virus on its website.

5. INFORMATION TECHNOLOGY AND CIVIL LIBERTIES

You are informed that, in accordance with the information technology, files and civil liberties law of 6 January 1978, information that you communicate, notably through the forms on this site, allows us to meet your requests and is intended exclusively for the Photocenter of ENGIE, who is responsible for its processing for administration, business or technical purposes. 6.1 RESPECT OF OTHERS

As user of the Photocenter website of ENGIE, you are obliged to comply with applicable legislation, in particular with the provisions of the law regarding information technology, files and civil liberties, infringement of which constitutes a criminal offence.

In particular, you must refrain from any collection or utilization for any purpose other than the original, specifically of personal information that you access, and in a general manner from any act liable to prejudice the private life, honor, sensitivity, brand image, reputation of any natural or legal person, and in particular that of ENGIE, by avoiding any defamatory, provocative, malicious, disparaging or menacing mention, message or text on any medium whatsoever.

6.2 RESPECT OF INTELLECTUAL PROPERTY RIGHTS

The general structure, the website, as well as the texts, data bases, images, know-how, and all the other elements constituting the Photocenter website are the exclusive property of ENGIE. The website software remains the property of the company Orphea – Oodrive Group, ENGIE’s service provider. Any representation of this site, in whole or in part, by any means whatsoever, without the explicit authorization of ENGIE, is prohibited and would constitute a forgery sanctioned, notably as a criminal offence, by articles L. 335-2 and following of the Intellectual Property Code.

Similarly, the trademarks and other distinctive signs, such as logos, figuring on the site are the property of ENGIE and any utilization of such by non-authorized third parties is strictly prohibited.

Any reproduction, in whole or in part, of these trademarks or logos without the explicit authorization of ENGIE is thus prohibited, no matter what the context or the medium used for such utilization, and carries sanctions, notably criminal, as provided by articles L. 716-1 and following of the Intellectual Property Code.

7. GENERAL TERMS AND CONDITIONS OF USE OF THE PHOTOGRAPHS OF THE PHOTOCENTER WEBSITE

The photographs presented on the Photocenter website are works protected by the Intellectual Property Code.

7.1 SITE ACCESS

In order to obtain an identifier and password enabling access to the website, the applicant must first register via the form available on the home page. When registering, the applicant undertakes to communicate accurate information only.

The authorized user is the physical person who has received by electronic mail an identifier authorizing access to the website. The login and password are strictly personal and must under no circumstances be transmitted to a third party.

The Photocenter reserves the right to refuse a registration request. The refusal, which shall not disclose the reason for said refusal, will be transmitted by email to the address indicated on the form. The information transmitted by the applicant will not be used by the Photocenter other than for general statistical purposes. The Photocenter reserves the right to interrupt temporarily or permanently, and without prior notice, an authorized user’s website access.

In such a case, the user undertakes to no longer use the thumbnails and/or photos already downloaded or recopied on any support.

7.2 USE OF LOW DEFINITION THUMBNAILS

The authorized user may download low definition photographs which may not however be diffused. On the other hand, they may be integrated into mock-ups, documents or projects For exploitation on Internet, Intranet (or any usage which requires only low definition photographs), the user undertakes to obtain prior authorization from the Photocenter.

The fact of downloading on the Photocenter site implies unreserved acceptance of the general terms and conditions set out in this document.

7.3 USER OBLIGATIONS

The user undertakes to:

  • Not disclose to third parties his identifiers for connection to the Photocenter of ENGIE,
  • Read the conditions of use for photographs (medium, duration and territory) and the restrictions on their distribution indicated on the notices for each photograph and comply with those conditions. Should the exploitation intended by the user not be acquired or not figure in the acquired rights, the user undertakes to contact the team of the Photocenter on +33 (0)1 86 90 30 40, in order to regularize the rights prior to any exploitation. In some cases indicated in the photo notices, the user must contact the party who sponsored the reporting directly.
  • Not modify the image of the persons, products or websites figuring on the photographs,
  • The information that appears in the “Credit” field must be indicated,
  • Never make a duplicate or reproduce, even partially, all or part of the photos supplied by the Photocenter without prior authorization,
  • Re-verify the rights from the notice of the photo in the event of a new utilization of the supplied photos and contact the Photocenter team should it be necessary to renegotiate the rights,
  • Respect the information contained in the title and captions of the photographs.

ANY INFRINGEMENT SHALL BE LIABLE TO PROSECUTION AS PROVIDED BY THE LAW ON THE USE OF PHOTOS WITHOUT THE AUTHORISATION OF THEIR AUTHOR
